Terms of service

These Terms of Service (the “Terms”) govern your access to and use of moonandjade.shop and related services (collectively, the “Services”). The Services are operated by Mingxia Zhang Li, a Pennsylvania sole proprietor doing business as Moon & Jade (“Moon & Jade,” “we,” “us,” or “our”). Our online store is hosted by Shopify.
By accessing the Services, creating an account, submitting information, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least the age of majority where you live to place an order, or you must use the Services with the authorization and supervision of a parent or legal guardian. Fortune, birth-profile, and AI features are not directed to children under 16. A person who is 16 or 17 may use those features only with permission from a parent or legal guardian. We do not permit a user to create a birth profile for another person.
2. Products and product information
We sell jewelry and accessories, including products made with elastic, natural quartz, alloy beads, and other materials identified on the applicable product page. Products may be supplied and fulfilled by third parties and may ship from China. Natural stones may vary in color, pattern, inclusions, and appearance. Product photographs and screen colors may not reproduce every variation exactly.
We try to describe products accurately, but we do not represent that gemstones or materials have medical, therapeutic, protective, or guaranteed metaphysical effects. Unless a product page expressly states otherwise, products are not intended for children under 14. A label alone does not replace appropriate adult judgment or supervision.
3. Orders, acceptance, and cancellation
Your order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, legal restrictions, or inability to deliver. We will refund amounts charged for an order that we cancel.
You may request cancellation within 24 hours after placing an order or before fulfillment begins, whichever occurs first. We cannot guarantee cancellation after fulfillment has begun. Mandatory cancellation or withdrawal rights that apply under local law are unaffected.
4. Prices, payment, taxes, and duties
Prices and available currencies are displayed at checkout. You authorize us and our payment providers to charge the amounts shown in your order. Taxes, duties, brokerage charges, and import fees are included only when checkout expressly states that they are included or prepaid. Otherwise, the recipient may be responsible for charges imposed by local authorities or carriers. We may correct pricing or listing errors before accepting an order.
5. Shipping and delivery
Our current estimate is 2–4 business days for processing plus 7–10 business days in transit, for an estimated total of 9–14 business days. These are estimates, not guarantees. Customs review, carrier disruption, weather, holidays, destination restrictions, and circumstances outside our reasonable control may cause delays. Additional terms appear in our Shipping Policy.
6. Returns, defects, and statutory rights
We do not offer voluntary returns or exchanges for change of mind except where applicable law requires otherwise. This does not limit rights relating to defective, damaged, misdescribed, incorrect, lost, or undelivered goods or mandatory cancellation and withdrawal rights. 7. Accounts and communications
You are responsible for providing accurate information, protecting your credentials, and notifying us of suspected unauthorized use. You must not submit payment-card details, passwords, or unnecessary sensitive information through contact, feedback, review, or chat fields.
8. Fortune, cultural, and AI content
Fortune, BaZi, zodiac, feng shui, I Ching, calendar, and other metaphysical or cultural material is provided for cultural, educational, entertainment, and reflective purposes. It is not a guaranteed prediction and is not medical, mental-health, legal, financial, safety, or other professional advice.
AI-generated material may contain errors, omissions, or inappropriate interpretations. Verify important information independently and do not rely on the Services as the sole basis for consequential decisions. If you are in danger or experiencing a medical or mental-health emergency, contact the appropriate emergency or qualified professional service.
9. Birth information and AI conversations
Where the feature is available, a “Use once” request processes the submitted birth information for that request and does not save a reusable birth profile. A “Save profile” request stores the selected birth information only after affirmative consent. Saved birth profiles and stored AI conversations may be deleted through the available account controls. Our Privacy Policy explains these practices in more detail.
10. Reviews, feedback, and user content
If reviews or other submissions are enabled, you must provide honest content based on your own experience and must not submit unlawful, infringing, deceptive, harassing, or malicious material. You retain ownership of your content, but grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, translate, format, and display it for operating and promoting the Services. We may moderate or remove content where reasonably necessary. Any material incentive connected with a review must be clearly disclosed and may not be conditioned on a positive review.
11. Intellectual property
Except where otherwise indicated, the Site and its original content are owned by Mingxia Zhang Li doing business as Moon & Jade or are used with authorization. Third-party names, trademarks, photographs, artwork, and other materials remain the property of their respective owners. No license is granted except the limited right to access and use the Services for personal, non-commercial purposes.
12. Prohibited uses
You may not use the Services to violate law; infringe another person’s rights; distribute malware; interfere with security or operation; scrape or access the Services by unauthorized automated means; impersonate another person; submit false information; or misuse the Services to make high-stakes decisions about another person.
13. Third-party services
The Services may rely on Shopify, payment providers, carriers, translators, messaging tools, AI providers, and other third parties. Their services may be governed by separate terms and privacy notices. We are not responsible for third-party services outside our control, but this clause does not exclude responsibility that applicable law does not permit us to exclude.
14. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted operation, error-free AI output, or any particular spiritual, personal, or commercial outcome. Nothing in these Terms excludes an express product commitment or a mandatory warranty, guarantee, or consumer right.
15. Limitation of liability
To the fullest extent permitted by law, Moon & Jade will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the Services. Where liability may lawfully be limited, our aggregate liability for a claim relating to a purchase will not exceed the amount paid for the affected product or service. These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence, statutory product liability, or any liability that cannot legally be limited.
16. Governing law
These Terms are governed by the laws of Pennsylvania and applicable United States federal law, without regard to conflict-of-law rules. This choice does not deprive a consumer of mandatory protections available under the law of the consumer’s habitual residence. Nothing here prevents a consumer from using a court or dispute process that applicable law makes available.
17. Changes
We may update these Terms prospectively. The effective date above will be updated, and additional notice will be provided where required. Terms in effect when an order was accepted continue to govern that order unless law requires otherwise.
